[Via Kotaku]A former Marine who worked for the National Security Agency has been sentenced to 10 years in prison.
Joshua Mottom, 35, was sentenced on Monday to 10 years in prison for leaking the classified National Security Agency (NSA) files to the media.
His lawyer Paul Tully told the judge the former Marine was not a target of the investigation into the NSA's eavesdropping program.
"What we want to emphasize is that he did not act upon a request by the President that he would face jail time for this very act - and what we will seek is not jail time for this, but a sentence that is just as harsh and will not amount to any more than a fine," Tully told the judge.
"He chose to engage in a deliberate and deliberate deception of the American people to do what he did."
The judge, who has been briefed on the case by former NSA contractor Edward Snowden, ruled the sentence would not be fair.
"This defendant was not a target of any investigation. He was a person, and he went public to do this in hopes of exposing what he is doing. He did not do that because he wanted to," Judge John Korte said.
The judge said he was aware of no evidence of any wrongdoing by Mottom in leaking the files, which included information that may have helped the NSA leak the 9/11 and other government information.
He said he was also aware of the fact that the judge did not consider that Mottom had already been sentenced, but that there was no evidence of any wrongdoing in leaking the files.
He said the judge was aware of the "very serious" nature of Mottom's actions, but noted that the government was still trying to determine if he was a target of the leak.
