The FCC says it cannot force broadband providers to maintain the rules.
"In the past, the FCC has held that the 'net neutrality' rules are in need of judicial review," the FCC said in its statement. "That is no longer the case."
The FCC's reasoning for denying the application of net neutrality rules is that it did not have the authority to impose those rules on broadband providers before the FCC moved to expand the statute to include broadband service.
The telecoms argued that the rules were not the same as the rules used to prevent internet service providers like Google and Facebook from discriminating in their advertising.
"The FCC's position is that it does not have this authority to impose the 'net neutrality' laws on broadband providers," a Verizon representative said in a statement.
The attorney general's filing is the first major attempt to stop the FCC from imposing net neutrality rules on broadband providers since the FCC's 2009 decision to stop the Obama administration from repealing the net neutrality rules.
Last week, The Intercept reported that the telecoms had pushed back on the FCC's attempts to block net neutrality rules by arguing that the FCC was acting on its own.
"Net neutrality is not a matter of the FCC's authority. It requires the FCC to act. The FCC's failure to act in its own interest is a violation of the FCC's First Amendment," former Verizon executive lawyer Matthew Capps said in an email.
The telecoms have challenged that position by using the "net neutrality" law to try and force broadband providers to keep them from offering better internet service. They have also argued that the rules need to be applied uniformly between broadband providers and internet service providers.
