The judge also ordered Bristol-Myers Squibb and Otsuka to pay $1.2 million in penalties to anyone who could not help pay for the entire settlement and $200,000 in legal fees.

"We expect the litigation process to be as streamlined as possible throughout this process," Judge Rodgers said in the decision. "We think there is a lot of merit to each side's claims. The outcome of the litigation process is a matter for our own review."

Bristol-Myers Squibb and Otsuka were fined between $1 million and $2 million, while Bristol-Myers Squibb and Otsuka were fined between $250,000 and $500,000.

The settlement was announced Monday in court documents. The deal was contingent on all parties agreeing to pay $1 billion in legal fees to each side if no agreement is reached.

The lawsuit, filed by Bristol-Myers Squibb and Otsuka, and its plaintiffs, Abilify, has now been consolidated into MDL.

Bristol-Myers Squibb and Otsuka has not yet filed any legal complaint against Bristol-Myers Squibb and Otsuka, but it is looking forward to working with Bristol-Myers Squibb and Otsuka and with Bristol-Myers Squibb and Otsuka on a settlement, according to the filing.
