This is the first time Verizon has implemented a new plan with no cap, which Verizon said would not require a permit of any kind.
However, an earlier lawsuit, filed by the United States Civil Liberties Union (U.S.C.L.U.) and the American Civil Liberties Union of Hawaii over Verizon's network coverage, also accused Verizon of throttling its service, which could result in people who are in the process of getting legal assistance getting their data and phone bills paid.
The lawsuit was filed in U.S. District Court in Honolulu last month and was eventually dismissed because of insufficient evidence.
The U.S.C.L.U said that, based on Verizon's previous data caps, "the company did not have a plan to comply with a federal law protecting First Responders from excessive data caps."
"The court found that Verizon intentionally throttled its Internet access, without sufficient evidence, and that the company could not lawfully use its network to protect First Responders from unauthorized use of that network," the lawsuit said.
The ACLU's lawsuit in the U.S.D.C. charged Verizon with violating the U.S.C.L.U. and Hawaii's Open Records Act, which governs data use in government agencies.
The lawsuit also said that the FCC's new plan would prohibit the data plan from "improperly slowing down or blocking access to information that a lawful first responder would have access to."
Verizon said it would not share the details of the new plans.
"We are reviewing the proposed Internet Access Plan and will continue to look for ways to improve the service provided by Verizon Wireless and will continue to look for ways to improve the service provided by Verizon Wireless to our customers," Verizon said in a statement.
The company said that it is reviewing the new plans, which it said will have more details soon.
The Verizon plan, however, could be a different story in Hawaii.
