Before the court order, the FCC's Public Information Officer, Michael Korte, said it's "unfortunate" that the court's ruling will not address a longstanding FCC rule "that prohibited ISPs from using unauthorised data requests as a means to target the interests of the majority of their users." He pointed to a similar ruling by Judge Neil Gorsuch in July that "clearly has been implemented in many respects, including in the FCC's response to the Trump FCC decision."

The ruling by the FCC also leaves open the possibility that the agency might try to change its policy to protect consumers from bulk comments. Since the FCC took over in February 2017, the agency has refused to release publicly any data on comments submitted in bulk, citing concerns that the company's data would be under-reported.

The FCC has yet to respond to a request for comment on such an issue.
