"It is my firm's belief that Defendant's attempt to circumvent the legal process, despite the fact that the audio recording was legally prohibited, was illegal and should not have been allowed," he added.

Williams is the second attorney in Harris County to sue Apple over the bug, the other being attorney Mark Geragos.

In 2013, Geragos told The Intercept that Apple's patent-infringement lawsuit against Samsung was "an embarrassment to both Samsung and Apple."

"Samsung has been on the receiving end of countless lawsuits over patent litigation since the 1990s, and we are now going to be going after Apple," Geragos wrote.

"I am not aware of any other company in the world that has done the same thing to Apple, either in court or otherwise, and neither do we. The patent-infringement case against Samsung is not a one-off. We have worked closely with Apple over the years, and we will continue to fight this case vigorously."

In June, Apple sued Samsung for patent infringement .

Samsung has argued that the bug is simply a workaround to the iPhone's bug.

"Samsung has taken a step back and clarified that no such feature was added to the iPhone during its initial development, and that no such feature was removed from Apple's original design. Samsung is continuing to fight back in court, and our team has already taken all necessary legal and technical steps," a Samsung spokesman said in response to  a request from The Intercept, which contacted Geragos.

The bug was discovered last year by a security researcher and is one of the main reasons many people were concerned about the iPhone's ability to speak to someone using the iPhone's microphone.

"The iPhone's microphone is a very powerful way of communicating with other phones, and many other people are using that microphone with their phones," The Intercept reported. "It's not a new idea. It's a new technology. The fact that it's a common feature has only gotten worse in recent months."

The iPhone's microphone is not a key part of the iPhone's microphone set-up.

"As Apple puts it: 'We're using our new microphone to communicate with you, not a microphone for recording'," Geragos said. "A typical microphone will only record the call. It won't record even if you're in a car
